Meng Wanzhou, chief financial officer of Huawei [HWT. UL], won a victory in the attack and defense of the law with the prosecution, according to a court decision released on Tuesday. The judge asked the Attorney General of Canada to submit more evidence and documents related to the arrest of Meng Wanzhou.
Heather Holmes, assistant chief justice of the Supreme Court of British Columbia, agreed that there was a "real possibility" for Huawei's legal team.
But she cautioned that her ruling was limited and dismissed Huawei's claim that Canadian authorities had mishandled Meng Wanzhou's electronic device messages.
On December 1, 2018, Canada arrested Meng Wanzhou at Vancouver Airport at the request of the United States. The United States accused her of bank fraud and misleading HSBC about Huawei's business dealings with Iran. Meng Wanzhou insists that he is not guilty and is fighting to avoid extradition.
Before she was arrested, she was questioned by Canadian immigration authorities, and her lawyer asked the government to hand over more documents about Meng's arrest.
Meng Wanzhou's lawyer group argued against her extradition in the Canadian court on the grounds that the United States regarded her extradition as a means to obtain economic and political interests, and the Canadian authorities conducted illegal detention, search and interrogation of Meng Wanzhou on behalf of the FBI.
Holmes wrote in the ruling that she found "a clear gap" in the evidence presented by the prosecution, citing why the Canadian Border Service (CBSA) "made a simple mistake of transferring the password that CBSA officials asked Meng Wanzhou to present to the Royal Canadian Mounted Police (RCMP), which was contrary to legal requirements."
